Delaware’s 50% front-side tint law is in force, with a guidance gap

In force since August 17, 2026

Delaware enacted a 50% front-side tint provision on August 17, 2026. Its older posted regulation still says 70%, and the reviewed sources do not fully resolve how the new material-based wording will be measured.

What changed

Delaware’s General Assembly records Senate Substitute 1 for Senate Bill 255 as signed and effective on August 17, 2026. The measure became Volume 85, Chapter 425, and its changes now appear in the state code.

The amended statute permits window tint or other material with at least 50% visible light transmission on the windows immediately beside the driver and the forward side wings. The legislature describes the previous general threshold as 70%. An earlier version proposed 35%; that figure was not the provision enacted.

What remains restricted

The law expressly allows material with 0% or greater transmission on rear side windows and the rear window. That addresses tint darkness, rather than every vehicle-equipment requirement. Windshield material remains limited to the transparent top-edge provision associated with the AS-1 boundary. The medical-statement exception remains, while the former statutory tint-certificate display requirement was removed.

Why the published guidance needs care

As of our October 14 review, Delaware’s posted Regulation 2277 still specified at least 70% transmission for front-side film and glass together, with a stated tolerance. That older text does not match the new statute’s 50% provision. We did not verify an updated agency rule reconciling the two.

There is also a measurement distinction: the new statute describes the transmission of the tint or other material, while the older regulation explicitly measures film with glass. The sources reviewed do not settle how officials will apply the new wording to a finished window. A product marked 50% should therefore not be presented here as a guaranteed inspection pass.

Before choosing an installation

Drivers should confirm current inspection guidance and ask the installer to distinguish the film’s rating from the finished-window reading. Commercial installers also have separate federal obligations: NHTSA has explained that state operating rules do not remove the federal restrictions on businesses making required glazing performance inoperative.

Before relying on this report

  • The 50% statutory provision is enacted and effective; the older posted 70% regulation has not been reconciled in the sources reviewed.
  • The reviewed sources do not conclusively resolve material VLT versus installed film-and-glass measurement under the new wording.
  • This report does not guarantee inspection outcomes or resolve every federal installation requirement.

This report is general information, not legal advice or a vehicle-specific compliance decision. A news item does not authorize a film installation or add a rule to our calculator.
